چور کی سزا
استاذ جاوید احمد غامدی صاحب نے جوابی بیانیہ کے لیکچرز میں تکفیر اور ارتداد کی سزا کے بیان میں یہ کہا کہ کہ کسی کو یہ حق/اختیار نہیں کہ وہ کسی کے مسلمان ہونے اور نہ ہونے کے فیصلے کرے… بات لمبی ہے لیکن مفہوم یہی ہے.
لیکن اب چور کے حوالے سے عدالت کو حق/اختیار دے رہے ہیں کہ وہ کسی چور کے شعوری یا غیر شعوری مسلمان ہونے کا فیصلہ کرے.
چور والی بات حال ہی میں ایک ویڈیو بیان میں کہی گئی ہے.
کیا یہ داخلی تضاد نہیں.

اصل فرق ایمان اور حق تلفی کا ہے۔ اللہ کے معاملات میں اللہ ہی کو اختیار ہے سزا دینے کا۔

For social matters e g collection of zakat or a crime, a state can tag people for administrative purposes. For example those who pray in Masjid and pay zakat can be legally considered muslims. This kind of identification was necessary in a muslim state where non muslims were subject to different laws or taxes.
In a nation state like Pakistan or india, the state does not have to know religion of its citizens. However if laws are different for different religions, the court give a choice to a criminal under what law he would like to be punished. In such a case, it’s the criminal and not the court who will select a religion.
