When one commits this act he is not violating any agreement he has made. All he is doing is accessing a video online. Would it be considered theft or knowingly aiding criminals since we know they have illegally obtained this footage and therefore be haram?

If something is illegal or immoral then it’s impermissible. A legal expert can tell you whether streaming pirated content is illegal or not in your state, but morally it’s not right to use the fruits of someone else’s labor without their permission.
