  • Jurisdiction Of Govt. In Law Making

I hope that this will be last thread on this topic and it will clear everything. Inshallah.

But I want to request you instead of referencing other threads just give me point to point answer.

Ghamdi Sb stated that Govt. can only make laws when there is haq talfi or ziadti.

Please give the general definition of both of them. Then I’ll continue my rest of question.

Haq Talfi menas not to give away someone his or her rights

Ziyadti means to transgress and usurp ones rights

      Right…

According to Ghamidi Sb. State can also make law regarding obscenity.

Obscenity is not haq talfi and ziadti.

      Then is this exceptional case?

In one video, ghamidi sb said ‘state can make law for the prevention of both zina bil jabar and zana bil raza’

Zina bil raza is also neither haq talfi nor ziadti

Things which leads to haq talfi and ziyadti are stopped by law this is called sadd e zarya. Obscenity leads to Zina that is why it can be stopped with the power of law.

Zina bil raza is not haq talfi or ziadti

      It’s of third type.

Why ghamidi sb not add this

      Haq Talfi, Ziadti and Zina

Zina with consent makes one unfaithful to one’s spouse, affect the family institution and thus makes the children suffer for having divuded attention. That is why even the otherwise very open society of West doesn’t allow extramarital relation. So it is haq talfi. For the same reason is not allowed to unmarried too in Islam. Here it is for Sadd e zarya, preventive measure. What has to be forbidden after marriage needs to be avoided before marriage too.

Thank you so much. Alhamdulillah cleared.

But should homosexuality also be prevented by Law?

It does the same as fornication that is ruining family institution.

Yes, of course. Law will not allow it and if reported legal action will be taken.
