Status Of Fasid Marriage
I know Dr Ghamidhi has discussed inter-faith marriages a few times, particularly the prohibition on muslim man marrying non-kitabi woman. However, I would like to get his point of view on the legal standing (islamic law) of such a marriage in light of recent decisions by Indian Supreme Court on Muslim Family Law that categorize marriage as “Fasid”, Batil (void) and Sahi (valid).
1) What is the definition of “Fasid” nikah?
2) Does the act of consummation and intimacy in a Fasid marriage considered “Zina”?
3) What is the legitimacy of the child (born from such union), right to inheritance and obligations of muslim parent ?
