    Sahih Bukhari Hadees # 3159

    ، فَأَمَرَنَا نَبِيُّنَا رَسُولُ رَبِّنَا صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ : نُقَاتِلَكُمْ حَتَّى تَعْبُدُوا اللَّهَ وَحْدَهُ أَوْ تُؤَدُّوا الْجِزْيَةَ

    اللہ کے رسول صلی اللہ علیہ وسلم نے ہمیں حکم دیا کہ ہم تم سے اس وقت تک جنگ کرتے رہیں۔ جب تک تم صرف اللہ اکیلے کی عبادت نہ کرنے لگو۔ یا پھر اسلام نہ قبول کرنے کی صورت میں جزیہ دینا قبول کر لو.

    صحابہ کرام رضوان اللہ علیہم اجمعین نے جو جنگیں کیں اگر وہ رسول اللہ صلی علیہ والہ وسلم کی دعوت کے انکار کے نتیجے میں تھیں تو ان میں مشرکین کو موت اور اہل کتاب کو محکومی کی سزا کیوں نہیں دی گئی؟

    Jizya is actually a part of that punishment for people of the book.

    The narration refers to two parties, one is Rome, who were christians (Maseehi) and second one is Persians (Faris) who were Zoroastrians (Majoosi) by religion. For people of the book (Jews and Christians), Quran has imposed living under Jizya as their punishment. As for the Persians, their imposition of Jizya Punishment was an Ijtihad done by Sahaba and it was in accordance with Quran (22:17) [1] and Saying of the Prophet (SWS).     [1]. إِنَّ الَّذِيْنَ آمَنُوْا وَالَّذِيْنَ هَادُوْا وَالصَّابِئِيْنَ وَالنَّصَارَى وَالْمَجُوْسَ وَالَّذِيْنَ أَشْرَكُوْا إِنَّ اللَّهَ يَفْصِلُ بَيْنَهُمْ يَوْمَ الْقِيَامَةِ إِنَّ اللَّهَ عَلَى كُلِّ شَيْءٍ شَهِيْدٌ.

Tell them:] “Those who have accepted faith and those who adopted Judaism and the Sabeans and the Nazarenes and the Magians and those who adhere to polytheism, God will decide among all of them [about their disputes] on the Day of Judgement.
