Divorce doesn’t happen itself becasue of lack of marital relations between a husband and wife. For a divorce to take effect, it needs to be given explicitly, in accordance with Quran and the state law. Therefore, the marriage is still intact unless Divorce was given properly.

Secondly, if inheritance law of a country is against Islamic Sharia, then Husband should’ve made the will as per Islamic Law of Inheritance. It was a religious duty of the Husband to make such a will. And in it’s absence, wife needs to distrbute the share she got in accordance with Islamic inheritance.

(Miyan biwi ka mehaz talluq na honay ki surat main tallaq khud sai waqai nhi hoti jab tak Tallaq Islamic Shariat aur Mulki Qanoon kai mutabiq na di jaye. Is liya Tallaq diya baghair khud sai tallaq waqai nhi hoti.

Aur agar mulki warasat ka qanoon Islamic Shariat kai khilaf hoo to husband ki zimmadari thii kai Islamic Shariat kai mutabiq wasiyat karay, yai uski deeni zimmadari hai. Aur agar uski wafaat aisi wasiyat sai pehlay hogae hai, to biwi ko jo warasat millay gi usko islamic shariat kai mutabiq sab main bantna hoga)
