  • Zakat From Back Date When Assets Were Not At One's Disposal

Posted by Umar Farooqi on April 14, 2022 at 3:35 am

My father died in Jan 2020 & left some amount in his bank account. This amount remained suspended due to procedural matters of succession from the concerned authority & couldn’t be distributed to the legal heirs till now.

Now we have completed the succession process & the amount is likely to be disbursed to the heirs shortly

I need to ask that once we receive the amount (let’s say in Jun 2022), should we need to pay the zakat for last 2 years i.e. 2021 & 2022 when we didn’t have the amount in possession OR Zakat will be applicable after 1 year from the disbursement i.e. in Jun 2023???

The principle is that for zakat to be due on an asset, it has to be at one’s disposal (tassaruf). If an asset is legally tied up, as in this case, then zakat doesn’t become due until distribution.
