kya zina ke gunah ke liye mafi manga aur khudko saja liye pesh karna dono shart hei

Laikin agar riasat kisi Zina kai mujrim ko Saza dai day, us sorat main uski shadi kisi parsa aurat sai nhi hoo sakti.

muje confusion ho raha hei agar tauba karle aur saja na ho kya tab bhi usko paak Daman wali aurat se shadi nehi karna chahiye..?
2. aur agar riyasat saja de bhi de kya phir bhi woh paak Daman aurat se nehi kar sakta

Moderator May 30, 2022 at 10:41 pmAgar aik shaks Zaani hai aur usko abhi saza nhi hue toh woh sachi toba kar kai pakdaman aurat sai shadi kar sakta hai.
Aur agar us shaks ko Saza ho gae hai aur usay riasat nai zana ka mujrim qarar dai diya hai, us surat main uska nikah kisi pakdaman aurat sai nhi hoo sakta.

Member May 30, 2022 at 10:49 pmThat’s not making sense at least to me why convicted by state is considered as separate thing. We see in normal days many people are not convicted by state even they are involved in these activities habitually just because of poor justice system. And a person who commit fornication with consent, he’s also not convicted. So it’s allowed to marry with those people?

Moderator May 30, 2022 at 11:48 pmالزَّانِيَةُ وَالزَّانِي فَاجْلِدُوا كُلَّ وَاحِدٍ مِنْهُمَا مِائَةَ جَلْدَةٍ وَلَا تَأْخُذْكُمْ بِهِمَا رَأْفَةٌ فِي دِينِ اللَّهِ إِنْ كُنتُمْ تُؤْمِنُونَ بِاللَّهِ وَالْيَوْمِ الْآخِرِ وَلْيَشْهَدْ عَذَابَهُمَا طَائِفَةٌ مِنْ الْمُؤْمِنِينَ الزَّانِيلَا يَنكِحُ إلَّا زَانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لَا يَنكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ وَحُرِّمَ ذَلِكَ عَلَى الْمُؤْمِنِينَ
The man and the woman guilty of fornication, flog each of them with a hundred stripes and let not compassion move you in their case in the enforcement of the law of God, if you truly believe in Allah and the Last Day. And let a party of the believers witness their punishment. The man guilty of fornication may only marry a woman similarly guilty or an idolatress and the woman guilty of fornication may only marry such a man or an idolater. The believers are forbidden such marriages. (Quran 24:2-3)
After this punishment has been carried out, no chaste man or woman should marry men and women who commit fornication. According to the Quran, such people can only marry among their own sort or among the idolaters. It does not allow the marriage of a pious woman with a man guilty of committing fornication nor does it permit a pious man to bring home such a woman in his house. Consequently, every such marriage is not considered legal in Islam. The words لَا يَنْكِحْ (he should not marry) denote prohibition of such marriages, and to explain this very aspect, the Almighty says: وَ حُرِّمَ ذَالِكَ عَلَى المُؤْمِنِيْن (the believers are forbidden such marriages).
However, this directive pertains only to the fornicators (both male and female) who have become liable to punishment once their crime has been proven. This is what grammatical rules dictate; ie. the words الزَّانِى لَا يَنْكِح (the male fornicator should not marry) and الزَّانِيَة لَا يَنْكِحُهَا (the female fornicator should not be married) of the third verse refer to الزَّانى وَالزَّانِيَةُ (the female fornicator and the male fornicator) mentioned in the previous one who have officially been convicted for their crime.

Member May 31, 2022 at 4:22 amagar woh Bach Gaya toh woh murjilm nehi hoqa aur woh paak Daman aurat se shadi kar sakta hai aur jisne tohmat lagai usko 80 lashes mare jayenge haa agar haqiqat me woh murjilm tha par woh logo ke samne Bach Gaya toh yeh allah aur uska mamla hei mujhe aisa lagta hei baki apko umer bhai atche tarah samjhyenge

Moderator June 1, 2022 at 1:11 amIf there is any corruption in judicial system then civil society and parliament should work to eradicate that corruption. However, as far as matters of imposing Islamic Punishments are concerned, they cannot be imposed by an individual alone. They can only be implemented by the state. The prohibition of a convicted adulterer to marry a chaste woman is also part of the punishment mentioed in Quran. Punishment of Adultery comprises of two parts: one part relates to physical punishment and the second part relates to societal status of that convict. Just the way an individual cannot implement the physical punishment on someone, similarly he cannot implement the second part of the punishment as well. They both can only be implemented by the state.

Iska yeh mtlb nahi k person ko khudi apnay ooper hraam krna h if he’s addicted such a scenario. Yeh kaisay pta chlta h k hurmat apnay ooper khud impose krni ya state kray gi. Jaisa k hraam to bohat c or khanay ki cheezain b hin to kia woh b state ki responsibility h k yeh cheez haraam h aap nay nahi khaani?

As far as the individual is concerned, he or she may opt to not marry someone for whatever reason, he or she is free to choose. We are talking about the situation when it will become legally binding for that adulterer where he will not be allowed to marry a chaste woman.
