    All crimes are proved on the basis of circumstantial evidence, while adultery, to be proven as a crime, has a requirement of four witnesses in Islam–which if not present–no circumstancial evidence can compensate for that and may also in return result in punishment of ‘Qadhf‘ for the individual reporting it. That is why this distinction remains between the two.

    But adultery is a crime, and even if you know then shouldn’t be publicized. But Ghamidi sahab said that crimes shouldn’t be hidden. Is adultery an exception in that tho?

      Those are crimes by nature which Ghamidi Sahab is referring to e.g. robbery, rape, terrorism, oppression etc. and will be called crimes wehther or not enough circumstancial evidence is available against the culprit. It will still be said that a crime has been committed.

      Adultery on the other hand is a major sin and is not a crime by nature. In Islam, it only becomes a crime when requirement of witnesses has been fulfilled, in its absence it cannot be called a crime. That’s the difference between these two. Infact, calling it a crime and reporting it to authorities in the absence of witnesses would result in punishment of ‘Qadhf‘ for the individual reporting it.

    Ok, so it means that it in itself is not a crime but a major sin. But if a believing Muslim get indulged in that then from God for the purpose of purification a punishment will be given. Can this be said?

    But if that’s right then this causes confusion that a thing which in it’s nature is a major sin but not a crime, on the basis of external factors (or requirement of four witnesses) becomes a crime. Like thing in it’s nature is a sin but why does it become a crime because of some external factor?

    It becomes crime because it violates the sanctity of family unit. that is why when comes in the notice of the authorities they take action. It threatens the institute of family when becomes known.

    That i understand, but I’m asking about it becoming a crime from a major sin to a crime because of some external factor (fulfillment of witnesses requirement)? Like killing, theft, robbery etc, they are crimes in their nature?

    This is what is responded above. Adultery threatens the sanctity of the institution of family. This provides basis to count it a social crime, like cheating on spouse is a crime, so is the fornication (before marriage Zina) is a crime as what is forbidden after marriage is forbidden before marriage too, as a preemptive measure and also to avoid the problem of sanctity of the line of the children and to ensure that the when child is born, he or she should have a father and mother bound to take care of him or her.
