    Assalamualaikum

    One reason given for making hijabs illegal can be that in west (or even not illegal on a state level but to leave it on e.g schools or employers to ban it on an institutional level) because it is mostly considered as a symbol of oppression. And oppression is “bagi beghairil haqq” (to do something against someone without any right of doing that), so on the basis that because it has become a symbol for oppression then we can make it illegal?

    (Having Hazrat Umar’s RA legislation in my mind that giving divorce is a personal matter but when he saw that it’s being used wrongly then he made a law). So doing qiyas on that?

    The analogy of Hazrat Umar is incorrect. He made it a judicial law for those who brought their cases to court. which means it is not more a private matter but they want the state to intervene.

    Its being a symbol of oppression is a perception, not a proven fact beyond debate. No one has right to impose one’s perception on the other. First they need to make a consensus on its being the symbol of oppression. the other party takes it a symbol of religion and according to their constitutional right, they demand the freedom to observe it.

    This is the conflict.
