    Hello there,

    My question is that where does the concept of hurmate Musahrat lie in details?

    Is is like it only establishes through proper halal nikah?

    Or it also establishes through Zina?

    And if it establishes through Zina, then hanafi scholars say that it also establishes through a lustful touch with a women or a lustful look inside her vagina? And if it establishes between a man and his mother then his nikah with father is annulled forever and if with his daughters-in-law then the woman becomes forever Haram to his son and nikkah annulled?

    So can you explain with what acts it’s established and if it is also establishes through Zina or Haram things then does it annul previous nikah along with woman being Haram forever??

    @irfan76 so according to ghamid Sahab, illicit relation with a women before marriage may cause it be not permissible to marry her mother or daughter but if marriage is done before then such acts would not be having any effect and would be just a sin of Zina or lustful touch?

    According to Ghamidi saheb an established nihak does not get affected by an illicit relationship with someone in the in-laws. However, so far as the problem of Zina before marriage is concerned that it may affect the nikah with someone in the in-laws, with whom zina is committed, I don’t know what is the opinion of Ghamidi saheb, and I have not formed an opinion yet, working on it. Maybe Umar Qureshi might help.

    They give lots of information and evidences that tell that such illegal actions do affect the already established nikkah etc. Like about ibn Abbas fatwa that a person’s marriage with his wife with whom he has many children, the woman has become Haram. And also some Asar from İmran bin Hussain (sahabi) etc and also a hadith of Prophet prohibiting marriage to mother and daughter of a woman who’s vagina has been seen by that same man etc,

    So what are the authenticity of such claims and hadith? And if it’s possible can some message be conveyed to ghamidi sahab to make a detailed lecture in this?

    Some narrations tell that Nikah in such cases does not go invalidated, while some others say that it goes invalid. The narration of Umme Hani does not specify that it was narrated from the prophet. Two different narrations are narrated from Ibn Abbas. No narration is unobjectionable.

    The matter is of Ijtihaad. Accordingto Ghamdi saheb there is not grounds to declare alrady established nikah invalid due to Zina with in law mehram. The narrations in favour of Ghamidi saheb’s opinion are in principle, right.

    As here in the chapter of sahih Bukhari at 5105. We see that tabi like Hassan Basri and sahabah like ibn Abbas, and what they said and Abu hurairah said that the wife does not become lawful until a person performs full sexual intercourse

    When nothing came from Quran and the prophet, the matter is now of Ijtihaad, the sahaba did Ijtihad too, which might be correct or not, depending upon the strength of the argument. You have our opinion. you can compare the arguments and can have your opinion.
