Marriage is an open declaration of a contract by a man and a woman to live permanently as husband and wife. This declaration should be in accordance with law of the land. (Please see: Discussion 29869)
However, there are certain requites of Nikah:
1) A nikah should be conducted through wealth – which refers to the dower (‘Mehar‘).
2) No adulterer has the right to marry a chaste woman and no adulteress has the right to marry a chaste man, except if the matter has not gone to court and the two purify themselves of this sin by sincere repentance.
3) No Muslim can marry a polytheist.
