Why Can't A Non-Muslim Woman Wear Whatever She Wants In Muslim Countries?
Assalamualaikum,
Recently France has banned wearing of abaya in schools.
A similar incident that was also happen in Karnataka, India.
I was watching ghamidi shahib lectures on Karnataka incident in which ghamidi sahab was saying: State has no right to interfere in personal matter of person as long as he/she does not violate the rights of other person which is violation of life, wealth and honor.
So we should appreciate the girl action because he was fighting for his rights.
So my question is, why can’t non Muslim women wear whatever she want because doing so will not violate other person rights.?
So why Muslim states interfere in personal matters of non Muslim who can be citizens of Muslim countries or can be tourist?
Does interference in personal matters of non Muslim by Muslim states is against the teachings of Islam?
If not, then does not it seems hypocrisy.

This is Ghamidi sb understanding which is not accepted by majority of Muslims scholars.
Moreover, Muslim state constitutions are not based on personal freedom or secularism. Hence, it is not allowed. Then there is cultural factor too.-
Understandable based on understanding of other Muslim Scholars that Islamic state is not based on personal choice or secularism.
However, I agree with Ghamidi sb understanding as it does not have to be accepted by other scholars to consider it inline with Islam.
So i was looking for answer according to Ghamidi sb understanding.
Even if there are cultural factors, Still oppposing something in culture does not violates the rights of other person in any way.

As a principle, dressing choice is an individual matter and no state has any authority to interfere in deciding an individual’s dress choice. However, it must be kept in mind that due to Islam’s sensitivity to adultery and its declaration as a crime, there are certain associations which ensue on their own and they may include certain objections to revealing clothes at a societal level.
A tourist has very right to wear whatever they want and there won’t be any objection, however, state can only inferere when a clear line has been crossed i.e. specific dresscodes are causing clear nudity or becoming a clear precursor to adultery in the society. But all of this needs to be established first by proving that such behaviour/dress is violating rights of others. And this applies to all, whether a Muslim or a Non-Muslim, a tourist or a local resident. As long as that clear line is not crossesd, the only tool available with the state is guidance, advice and counselling.

In every country, state, town or community there are basic understanding of moral standards and dress code. In Pakistan, it may be not to wear revealing clothes.
Let’s forget about Pakistan consider this…why can’t women walk completely naked everywhere and have sex open in public in European countries?
For everything there is a proper place. In European countries, at nude beaches, nakedness may be acceptable, but not in general public. A bikini or speedo may be appropriate at beach but not in kids school or office meeting. So even in European countries there are boundaries and places for each type of dress. Similarly Pakistan is a place where revealing and tight clothes mat not be acceptable even though such dress is acceptable in public in European countries.
