    hello there, assalaam u alaikum.

    my question is that if a child commits zina with another child, both not reaching puberty. if they know to some extent that if they do such thing then “Allah gunnah dega”. they know it’s kind of sin but they aren’t fully aware of Quran, the punishments of 100 lashes and prohibition of marriage with chaste opposite gender. they only have a little bit knowledge that it’s sin, that which their parents told. now if their case of Zina becomes public and reaches court.

    would they be sinful in eyes of Allah? Or considered Zani in eyes of Allah?

    would they be considered Zani in the court? would they be stopped from marrying someone chaste later in their lives?

    We know from the Quran that God considers excuses. He announced half punishment for slave girls who were kept safe from committing adultery and still they committed Zina. This is because they did not have adequate education and environment. see tje verse: 4: 25

    فَإِذَا أُحْصِنَّ فَإِنْ أَتَيْنَ بِفَاحِشَةٍ فَعَلَيْهِنَّ نِصْفُ مَا عَلَى الْمُحْصَنَاتِ مِنَ الْعَذَابِ

    The children have more excuses for that. Children are not addressees of Shariah until they gain the sensibility to understand what they are responsible for and why.

    @Irfan76 so sir the children remain chaste? and even if the whole city knows their act as a child. the court knows it too. even then they would remain chaste and would be allowed to marry someone chaste in the lives in future?

    Yes. How many know that, makes no difference to a sin or a crime. Only that zani is not marriageable for the believers who deserves no concession and is sentenced to the prescribed punishment

    @Irfan76 and sir if at the time of prophet if a slave committed Zina. they would receive half punishment, right? but would they be held non-marriable to a chaste man/woman?

    A slave’s status being declared adulterer disqualifies him to marry a chaste woman.

    In principle, concession is always limited to the prescription. it is not extended.
