  • When A Women Can Marry After Obtaining Khula

Posted by Sana Malik on January 15, 2024 at 2:34 am

I obtained a khula, and the court issued the khula order on 20-09-2023 (after considering 3 months reconciliation period 20-06-2023 ~ 20-09-2023])

Subsequently, the document was forwarded to the respective union council, which provided the khula certificate on 25-12-2023 (mentioning that divorce is effective from this date)

I am confused about the effective date of the divorce. Is it the date when the court issued the order, or the date when the union council issued the certificate?

What is the iddah period in this case, and when can I remarry according to Sharia law?”

The actual iddah period starts from the date the divorce is pronounced. However for legal procedures, the date issued by the court should be considered. The union council should have issued the date accordingly. If there is some glitch you can consult your lawyer the union council to correct it. Or it may cause some legal problem with your second nikah.
