I have watched Sir Ghamdhi 22 min long video on homosexuality and Not satisfied with the answer. Jab tak ghamdhi sahab ne iss amal ko ikhlaqi lihaz se ghalat qarar dene k lie istadlaal kia tab tak baat bilkul aqali lag rhi thi. Lakin me ghamdhi sahb k jawab k dosere hisay se ikhtelaaf kerta hun jaha per unho ne kaha k qanoon sazi hoskti hai. ghamdhi sahab k hi endorse ki hui premises iss bat ki ijazat nhi deti k iss mamlay me sahib a iqtedaar ko ye haq hasil ho k maroof or munkar k ilawa kisi mamlay me qanoon sazi ker sakay. Maroof or munkar ki tafseel me ghamdhi sahb kehte hain k asaa amal jis me kisi dosere insaan ki haq talfi huti ho. Jab k iss muamlay me dono ki raza huti hai tu haq talfi ka swal hi paida nhi huta. Traffic k qnoon ki misal issliee nhi di jaa sakti kiu k uss se ap dosere logo ki jaan ko khatre me dal dete ho jin ki marzi shamil nhi huti apke rawaya per. Orr akhiri jumla b kuch ghalt mehsos hua k agar new methods se safai ka khiyal rakhaa jai tu waha khana dal k khaa lein , yehi bat hum jins parast mian biwi k taloqaat k bare me b keh sakte hain.
Please admin agar mera ye sawal ghamdhi sahb tak pohancha dein k kia hum jins parasti per saahib e iqtedaar ko ye haq hasil hai k wo iss mamlay me qanoon sazi kere agarche iss amal me kisi insan ka haq talf nhi horha. Or agar ghamdhi sahb ne iss bare me kuch likha ha tu wo b refer ker lein please.

According to Ghamidi Sahab, act of adultery results in violation of rights of the newborn in the society by effectively deteriorating the family structure in a scoiety, hence the punishment of Adultery falls in the domain of law making of a state and Islam endorsed it (Please see: Discussion 62084 • Reply 62188). Similarly, If homosexuality permeates in a society to an extent where it is feared to damage socio-familial fabric of a society the way adultery does, then law makers of a Muslim majority country can prescribe some punsihment as an extreme measure and declare it a crime. The impact here needs to be considered at a collective societal level, not at an individual level. But no law can be made to give capital punishment except for murder or Muharaba (fasad-fil-arz). Any lower punishment can be agreed upon by the society through parliament (Please see: Discussion 69775).

یہی سوال زنا بالرضا کے بارے میں بھی پیدا ہوت ہے کہ اس میں کسی کی حق تلفی نہیں ہوتی تو شریعت میں رضامندی کے ساتھ زنا پر سزا کیوں دیتی ہے۔ زنا یا ہم جنس پرستی بھی حق تلفی ہے۔ اسی وجہ سے منع ہے اور اگر پارلیمنٹ میں اس کو عقلی بنیادوں پر حق تلفی ثابت کیا جا سکے تو اس پر قانون سازی ہو سکتی ہے۔
جنسی داعیہ مرد اور عورت کے درمیان تعلق قائم کرنے کے لیے پیدا ہوا ہے تاکہ خاندان کا ادارہ قائم ہو اور انسان کو اس کی پیدایش سے لے کر بڑھاپے تک کے لیے جسمانی اور جذباتی ضروریات کی تسکین کا سامان میسر آ سکے۔ یہ بنیاد اگر تسلیم کر لی جاتی تو زنا بارضا اور ہم جنس پرستی دونوں کے خلاف قانون سازی ہو سکتی ہے۔
باقی رہا پاکیزگی کا معاملہ تو انفرادی معاملہ ہے ۔ اس کے تناظر میں قانون سازی نہیں ہوگی۔ یہ اوپر بیان کیے گئے مقدمے کو تسلیم کر لینے کے بعد ہی ہوگی۔
